Resident Relocation Plan — What to Know

The Camp Hill Square Apartments complex, constructed in 1971, is included in the overall redevelopment plan for the Emory Grove community in Gaithersburg. To prepare for the exciting revitalization of that historically important area of Montgomery County, the Housing Opportunities Commission (HOC) is implementing a carefully planned relocation of current Camp Hill Square residents.

The relocation plan provides a number of options that enable residents to make decisions about their new housing arrangements to best fit their individual circumstances. Please explore the FAQ below to learn answers to many of the questions you may have about your relocation options.

Why are Camp Hill Square residents being displaced?

The Camp Hill Square property, constructed some 55 years ago, is going to be demolished and redeveloped into something new.  In December 2021, HOC authorized the Executive Director to enter into a Purchase and Sale Agreement for the disposition of HOC’s Emory Grove Village and Camp Hill Square properties to Hailey Development, LLC (“Hailey”). Hailey plans to redevelop the property, including approximately 79 units of townhomes for sale and 60 units of rental apartments, which will be known as the Heritage Emory Grove redevelopment (“HEG Development”). Current residents of Camp Hill Square will have the Right to Return to the newly developed rental property; however, they will be required to reapply and requalify.

Will I receive a Notice to Vacate?

Yes, you will be provided written notice of the date by which you will be required to move. This date will be no less than 90 days from the date we provide you housing options for a dwelling unit that is comparable and similarly located to your current home (“Comparable Replacement Housing“).

Do I have to move now?

No, you do not need to move now. You will be provided written notice of the date by which you will be required to move. This date will be no less than 90 days from the date Comparable Replacement Housing has been made available to you. 

When will I have to move?

All residents must move by the end of August 2026.  Residents who are currently receiving subsidy assistance under the Project-Based Rental Assistance (“PBRA“) Housing Assistance Payment (“HAP“) contract may be eligible for a Tenant Protection Voucher (“TPV“) that will allow them to relocate to a property of their choice and still receive subsidy assistance. 

Residents who are not under the PBRA HAP contract can move at any time when they have found a replacement unit.  Residents who currently have a Housing Choice Voucher (“HCV“) will need to follow all of the relocation requirements for the HCV Program, including requesting a relocation voucher.

Will I receive moving assistance?

Yes.  Since you are being displaced from Camp Hill Square in connection with this redevelopment project, you may be eligible for relocation assistance and payments under the Uniform Relocation Assistance and Real Property Acquisition Policies Act (“URA“) and/or Montgomery County Code Chapter 53A (“County Chapter 53A“).  This Act confirms that under no circumstances shall the residents pay for any relocation costs incurred as a result of this process. 

What does relocation assistance include?

The relocation assistance to which you are entitled includes:

Relocation Advisory Services – Including counseling and other assistance to help you find another home and prepare to move.

Payment for Moving Expenses – You may choose:

  • A payment for your actual reasonable moving and directly related expenses, or
  • A fixed moving payment based on the URA Fixed Residential Moving Cost Schedule for your unit size;
  •  A combination of both.

HOC can also provide you with boxes and packing supplies, provide packing assistance if requested, and provide a Relocation Specialist to arrange your move with one of our contracted moving companies who will be paid directly by HOC. You will not have to pay moving costs if HOC arranges your moving using one of their contracted moving companies.

Replacement Housing Payment – Under URA, you may be eligible for a comparable replacement housing payment to rent or buy a replacement home.

Tenant Relocation Payment – Per the County Chapter 53A Tenant Displacement regulation, you may be eligible for a relocation assistance payment.

How is the Replacement Housing Payment determined?

The payment is based on several factors including:

  • the monthly rent and cost of utility services for a Comparable Replacement Housing,
  • the monthly rent and cost of utility services for your present apartment home, and
  • for low-income persons, 30% of your average monthly gross household income.

This payment is calculated on the difference in the old and new housing costs for a one-month period and multiplied by 42, but not to exceed $9,570.00 in total.

How is the Tenant Relocation Payment determined?

The payment is equal to two months’ of rent.  More specifically, per the County Chapter 53A Tenant Displacement regulation, residents may be eligible for a relocation assistance payment.  After receiving a notice of conversion, which is the Notice of Displacement letter that is being sent to all Camp Hill Square residents notifying them of the property closure and their relocation rights, a resident may terminate their lease without penalty by giving the owner at least 30 days’ written notice. The owner must pay relocation assistance equal to twice (2x) the monthly rent that the resident is paying at the time of the notice. Payment must be made to the tenant not more than ten (10) days after the owner receives a resident’s notice of termination if the resident:

  • agrees to move out of the rental housing within 180 days after the resident receives the notice of conversion; and
  • has paid all rent due at the time that the relocation payment is due to the resident. 
Am I eligible to receive both a Replacement Housing Payment and a Tenant Relocation Payment?

No. HOC must comply with both the URA and County Chapter 53A requirements but is not required to pay both relocation payments. All residents are eligible for the Tenant Relocation Payments equal to two months’ rent under County Chapter 53A.  Replacement Housing Payments under URA will be calculated as described above and will only be paid if there is a difference between the current apartment rent and the actual Comparable Replacement Housing rent and is not a fixed amount, but it will not exceed $9,570.00.  Residents may receive either one of the payments.

What if I want to purchase a home rather than continuing to rent?

Should you choose to purchase (rather than rent) a decent, safe and sanitary replacement home, you would be eligible for a down payment assistance payment which is equal to your maximum replacement housing payment or the Tenant Relocation Payment amount provided in your Notice of Displacement letter.  This amount will not exceed $9,750.00.

What if I find my own Replacement Housing?

You have every right to find your own replacement housing.  However, before you rent or buy, ask the HOC to inspect the unit to make sure that it is decent, safe, and sanitary.  If the housing unit is not decent, safe, and sanitary, you will not receive a Replacement Housing Payment. Tenant Relocation Payments do not require unit inspections.

Does my new apartment need to be inspected for me to receive replacement housing payments?

Yes. In order to receive a Replacement Housing Payment, the replacement housing must be inspected in order to ensure it is decent, safe and sanitary before any replacement housing payments are made.  Tenant Relocation Payments do not require unit inspections.

If I move in with my family or friends am I eligible for replacement housing payments?

No. Your replacement housing payments are based on the actual cost of the dwelling.  We will not base your payment on any dwelling that is not a Comparable Replacement Housing. However, you will still be eligible for the Tenant Relocation Payment.

How do I receive my Replacement Housing Payments?

You must file a claim for each relocation payment.  The Camp Hill Square Community Manager will provide you with the required claim form, help you to complete it, and explain the type of documentation, if any, that you must submit in order to receive the payment.  HOC can only issue checks to make these payments to you.

You must file your claim within 18 months after the date you move.  However, it is to your advantage to file as soon as possible after you move.  The sooner you submit your claim, the sooner it can be processed and paid.  If you are unable to file your claim within 18 months, ask the Camp Hill Square Community Manager to extend this period.

How do I receive my Tenant Relocation Payment?

If you choose to receive the Tenant Relocation Payment equal to two months’ rent, you must give your Community Manager at least thirty (30) days written notice that you intend to terminate your lease and provide the Community Manager with the date that you will leave your rental housing.  HOC must pay you the Tenant Relocation Payment within ten (10) days of receiving your notice to terminate the lease if you are current on your rent.  You must continue to pay rent to the landlord from the time you submit your notice to vacate until the time that you vacate your unit.  HOC can only issue checks to make these payments to you.

Why is the Replacement Housing Payments amount $0.00 on my Notice of Displacement?

Residents with subsidy who pay 30% of their income toward rent and who are eligible for subsidy at their replacement housing location, such as those who have a Housing Choice Voucher or who are under the Project-Based Rental Assistance program and may receive a Tenant Protection Voucher, may not be eligible for assistance under URA.  However, residents who may not be eligible for Replacement Housing Payments may still be eligible for Tenant Relocation Payment equal to two months’ rent under County Chapter 53A.

Do I still have to pay rent to Camp Hill Square after I receive the Notice of Displacement or a Notice to Vacate?

Yes, you are required to continue to pay rent to Camp Hill Square until you vacate the property and move to your replacement housing property.

Relocation Housing

Is it possible for me to move to Cider Mill Apartments?

Yes, all residents from Camp Hill Square may apply for housing at Cider Mill Apartments. 

Do residents under the Project-Based Rental Assistance (PBRA) program at Camp Hill Square have to move to Cider Mill?

HOC is submitting a request to the U.S. Department of Housing and Urban Development (“HUD“) to transfer the PBRA subsidy for 10 units under the PBRA HAP Contract from Camp Hill Square to HOC’s Cider Mill property.  Moving to Cider Mill will allow residents to retain their existing PBRA subsidy.  Residents currently receiving PBRA subsidy who choose to relocate to a unit outside of Cider Mill may be eligible for a Tenant Protection Voucher (“TPV“) if they choose not to relocate to Cider Mill.  Residents currently receiving PBRA subsidy may also receive a TPV if the request to transfer the subsidy to Cider Mill is not approved by HUD before the date that they will be required to vacate Camp Hill Square.

What do I need to do once I receive the notice to vacate if I have a Housing Choice Voucher (HCV)?

Residents currently under the HCV program who have a tenant-based voucher will need to complete a Housing Choice Voucher relocation packet with HOC and follow HOC’s standard voucher issuance and lease-up process. Residents should contact the Camp Hill Square Community Manager to receive a Relocation Packet to begin the relocation process.  Once a relocation voucher has been issued, HOC staff will work with residents to locate an appropriate relocation housing unit either at another HOC property or in a unit of their choosing.

Do I have to move to one of the three Comparable Replacement Housing that was listed in the Notice of Displacement letter that I received?

No, residents can move to any relocation property of their choice.  The Comparable Replacement Housing units were most representative of your current home and had units available at the time that the letter was sent to you.  Cider Mill may also be a relocation option for all residents of Camp Hill Square.

Is help available to help me complete all of the required paperwork?

Yes, Pratum Property Management site staff and HOC Resident Services staff will be available to assist residents with completing the required paperwork for relocation.

Will I get my Security Deposit back from Camp Hill Square?

Yes, residents will have their security deposit refunded along with interest from the time that they moved into their current unit until the date that they vacate Camp Hill Square.  The deposit and any interest payments will be applied to outstanding debts, if any, and then refunds will be sent approximately 45 days from the move-out date.  Residents must provide the forwarding address for their relocation unit to ensure that the payment is received timely.

Moving

Will HOC supply boxes and packing supplies?

Yes, if you choose for HOC to coordinate your move rather than opting for reimbursement or fixed payment for moving expense, then HOC will provide boxes and all packing supplies required for your move. Once your tentative move date is determined, HOC’s Relocation Coordinator will do an assessment of your unit and schedule the delivery of boxes and packing supplies.  If additional moving supplies are needed, you can contact the Camp Hill Community Manager and additional supplies can be delivered to you prior to your move.

Do I have to pay for my move?

Residents have several options to cover the cost of moving to their relocation units.  You will not incur any moving costs if HOC arranges your moving using one of their contracted moving companies. HOC has several licensed and bonded moving companies under contract and HOC will coordinate and pay for all moves and packing supplies required for the moves. 

Residents may choose to coordinate their own moves and HOC will reimburse residents for:

  • a payment for your actual reasonable moving and directly related expenses, or
  • a fixed moving payment based on the URA Fixed Residential Moving Cost Schedule for their unit size; or
  • a combination of both.
Can I get help with packing the items in my unit?

Yes, packing assistance will be provided when requested for elderly and disabled residents. Please contact the Camp Hill Square Community Manager prior to your move date to request packing assistance.

Will someone help me with transferring my telephone/cable/internet services and changing my address?

Yes, the Camp Hill Square Property Management and Resident Services staff will be available as needed to assist with coordinating the transfer of telephone, cable and internet service and completing a change of address request with the U.S. Postal Service. Residents may be eligible for reimbursement for expenses related to setting up utilities at a replacement dwelling, including connection fees, hookups, and deposits. You must file a claim for each relocation payment.
