The below Terms and Conditions apply to all HOC programs.

If you are 18 years old or older and are signing up for a program on behalf of yourself, then please refer to the Terms and Conditions (Adult).

If you are 18 years old or older, are the legal guardian of the children listed in the program registration form, and are signing up for a program on behalf of your minor children, then please refer to the Terms and Conditions (Minors).

If you are 18 years old or older, are the legal guardian of the children listed in the program registration form, and are signing up for a program for yourself and your minor children, then please refer to the Terms and Conditions (Adult) for yourself and the Terms and Conditions (Minors) for your children.

TERMS AND CONDITIONS (ADULT)

I am 18 years of age or older and am signing up for a Housing Opportunities Commission of Montgomery County (“HOC”) program. I hereby acknowledge and agree to the following Terms and Conditions (these “Terms and Conditions”).

General:

  1. I understand that HOC coordinates programs that are sometimes held at residential sites. A residential site may be owned by a limited liability company, limited partnership, or corporation (the “Ownership Entities”) that is owned or controlled by HOC. To the extent applicable, any reference to HOC in these Terms and Conditions shall also include the Ownership Entities (including, but not limited to, the Release of Liability, Waiver, and Indemnification).
  1. I understand that HOC engages volunteers, other organizations, or guests to facilitate some programs.
  1. I understand that participation in any activity or program is completely voluntary and not a condition of my HOC housing (if applicable).
  1. I understand that HOC may provide snacks and/or meals to program participants. To the best of my knowledge, other than explicitly indicated on the registration form, there are no food allergies, physical conditions, or other conditions that will interfere with my participation in the program.
  1. I understand and acknowledge that the program has an inherent risk of injury, personal property damage, and possible death. I freely and fully assume all risks, dangers, and hazards related to the program, including the possibility of personal injury, death, and property damage, and assume all losses resulting therefrom.
  1. I hereby approve and consent to emergency treatment.
  1. Nothing in these Terms and Conditions limits my ability to make a claim directly against a third-party facilitating a service or program or its insurance carrier.

Videoconferencing (if applicable):

 

  1. I understand that HOC coordinates programs that are being offered virtually via the internet and through videoconferencing, and that the videoconferencing platform is being provided by a third-party.
  1. I understand that videoconferencing is an online communication tool allowing for face-to-face video, voice, and/or text-based chat dialogue. I further understand that internet-based communication is not 100% guaranteed to be secure or confidential, and that my participation in videoconferencing is at my own risk. I freely and fully assume all risks related to my participation in videoconferencing, including the loss of my confidential information.
  1. By signing these Terms and Conditions, I am waiving certain legal rights, including the right to sue or claim compensation following the loss of my confidential data.


Transportation (if applicable):

  1. I understand that I will be traveling in an HOC passenger vehicle driven by an HOC employee (the “Transportation Service”). I fully intend that all releases, waivers, and indemnifications provided herein shall apply to the Transportation Service.


Release of Liability, Waiver, and Indemnification:

  1. 1. I hereby agree to waive, release, and forever discharge HOC, each Ownership Entity (to the extent applicable), and their respective Commissioners, directors, officers, agents, affiliates, subsidiaries, partners, members, lenders, employees, volunteers, successors and assigns (“HOC Parties”) from any and all claims and causes of action that I have or may have now or in the future against HOC Parties arising from or in any way related to, directly or indirectly, my participation in the program, including any such claims or causes of action caused in whole or in part by the negligence of HOC Parties. I understand that my participation in the program is voluntary and at my own risk, and I agree that I will not bring any claim or cause of action of any kind or nature against HOC Parties that might be in any way caused by participation in the program. I further agree to indemnify, defend, and hold HOC Parties harmless from and against any and all claims and liability for any loss, damage, expense (including attorneys’ fees and litigation expenses), or injury that I may suffer as a result of my participation in the program, including any claims, liability, losses, damages, expenses, and injuries caused in whole or in part by the negligence of HOC Parties. I intend these Terms and Conditions to be a complete and unconditional release of liability to HOC Parties to the greatest extent allowed by law.

 

Miscellaneous:

  1. These Terms and Conditions shall be governed by and interpreted solely in accordance with the laws of the State of Maryland, without reference to principles of conflicts of law.

  2. Each provision of these Terms and Conditions shall be considered severable, and if for any reason any provision that is not essential to the effectuation of the basic purposes of these Terms and Conditions is determined to be invalid or contrary to any existing or future law, such invalidity shall not impair the operation of or affect those provisions of these Terms and Conditions that are valid.

  3. Reference to the singular includes a reference to the plural and vice versa.

  4. These Terms and Conditions may be signed by electronic signature, which shall be considered as an original signature for all purposes and shall have the same force and effect as an original signature.

  5. I am 18 years of age or older, have read (or listened to) these Terms and Conditions and fully understand its terms, and have signed it freely, without force, and without any inducement or assurance of any nature.

  6. These Terms and Conditions shall be effective and binding upon and against me and my heirs, next of kin, executors, administrators, assigns, and representatives.


TERMS AND CONDITIONS (MINORS)

I am 18 years of age or older and am the legal guardian of the children listed in the program registration form. I am signing up for a Housing Opportunities Commission of Montgomery County (“HOC”) program on behalf of my minor children. I, on behalf of myself and my children, hereby acknowledge and agree to the following Terms and Conditions (these “Terms and Conditions”).
